Junk Car Medics – Terms of Use

Welcome to Junk Car Medics (“Junk Car Medics,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the website located at https://www.junkcarmedics.com/, any related mobile websites, and any mobile application we make available (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1) Electronic Agreement; Changes to Terms

These Terms constitute an electronic contract. We may update these Terms at any time by posting the revised version on the Service. Your continued use of the Service after a change is posted constitutes your acceptance of the revised Terms.

2) Access and Retention

To access and retain these Terms electronically, you need internet access and a device capable of viewing web content. We recommend you print or save a copy for your records.

3) Eligibility and U.S.–Only Service

You must be at least 18 years old, a resident of the United States, and able to enter into a binding contract to use the Service. The Service is offered and made available only within the United States. If you access the Service from outside the U.S., you do so at your own risk and remain responsible for compliance with applicable laws; however, we do not accept transactions outside the U.S.

4) Account Creation and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@junkcarmedics.com of any unauthorized use. Provide accurate information and promptly update any changes.

5) Commercial Use of Service

If you use the Service on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms, and “you” will refer to both you and that entity.

6) Prohibited Conduct

You agree not to: (a) scrape, crawl, harvest, or use automated means; (b) reverse engineer or circumvent security; (c) post unlawful, infringing, obscene, or abusive content; (d) impersonate others; (e) upload malware or harmful code; (f) send spam or unauthorized solicitations; (g) interfere with Service operations; or (h) use the Service in violation of law or these Terms. We may investigate and take appropriate action, including suspension or termination.

7) Offers, Inspections, Title, and Pickup

To facilitate pickup and payment, you authorize Junk Car Medics to share your contact information with its licensed carrier or recycling partners solely for purposes of fulfilling your accepted offer.

• Offer; Expiration. Any quote or price we provide (an “Offer”) is based on your submitted information and expires after seven (7) days, unless we state otherwise in writing.
• Verification; Adjustments. All Offers are subject to in-person verification at pickup. If condition, title status, VIN, keys, or included parts differ from your submission, we may adjust or withdraw the Offer at our discretion.
• Ownership & Title. You represent that you have lawful ownership and the authority to transfer title, and that the vehicle is free of undisclosed liens or holds. If a lien exists, you must disclose it and provide payoff details; where permitted, we may remit payoff and net the amount from your payment.
• Documents & ID. You must provide a valid government-issued ID and any documents reasonably required to complete transfer under applicable state law.
• Condition; Keys; Personal Items. You must disclose material conditions (including prior total loss, flood, and major damage) and provide all available keys/remotes. Remove all personal items before pickup.
• Hazardous Materials; Plates. Vehicles must not contain hazardous or illegal materials. Remove license plates where state law requires.
• Pickup; Risk of Loss. Risk of loss transfers to us upon completion of pickup and required title transfer, as reflected in our pickup documentation.
• Payment. Payment method (e.g., certified funds or electronic transfer) will be disclosed prior to pickup and is made upon successful verification and completion of pickup.

8) Your Representations and Warranties (Vehicle Sales)

You represent and warrant that: (a) you are the lawful owner or have authority to sell; (b) the VIN and vehicle details provided are accurate; (c) there are no undisclosed liens, security interests, or governmental holds; (d) the vehicle is not stolen and any salvage/total-loss/flood status has been disclosed; and (e) any required odometer disclosures are truthful and complete.

9) SMS Terms and Consent

By providing your mobile number, you agree that Junk Car Medics may send you SMS/text messages for service updates, appointment scheduling, reminders, and promotional offers. Message frequency may vary (typically no more than 4 messages per month). Message and data rates may apply. You may opt out at any time by replying STOP; for help, reply HELP or contact hello@junkcarmedics.com. Consent is not a condition of purchase. See our Privacy Policy for details.

10) Intellectual Property

The Service, including all content, design, text, images, logos, and software, is owned by Junk Car Medics or its licensors and protected by law. You may not use our trademarks, trade dress, or content without prior written permission, except as expressly permitted by these Terms.

11) Your Content; Feedback License

We do not claim ownership of content you submit (“Your Content”). You grant us a worldwide, royalty-free, non-exclusive, irrevocable license to use, host, reproduce, modify, adapt, publish, display, distribute, and create derivative works from Your Content for operating and improving the Service and our business. If you submit ideas or feedback, you grant us a royalty-free, worldwide license to use them without restriction or compensation.

12) Reviews

You may post reviews subject to these Terms. We may, but are not obligated to, remove reviews at our discretion.

13) DMCA/Copyright Policy

We respect intellectual property rights. If you believe content infringes your copyright, send a notice including all elements required by 17 U.S.C. §512(c)(3) to our Designated Agent:

We may terminate accounts of repeat infringers consistent with the DMCA.

14) Third-Party Content; Links

The Service may contain third-party content and links (“Third-Party Content”). We do not control or endorse Third-Party Content and are not responsible for it. Your use of Third-Party Content is at your own risk and may be subject to the third party’s terms and policies.

15) Modifications; Suspension; Termination

We may modify or discontinue the Service, or suspend or terminate your access, at any time, with or without notice. Upon termination, provisions that by their nature should survive will survive.

16) No Employment or Agency

These Terms do not create an employment, agency, partnership, or joint venture relationship.

17) “As-Is” Service; Warranty Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

18) Limitation of Liability

To the fullest extent permitted by law, in no event will Junk Car Medics be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our aggregate liability to you will not exceed the greater of $500 or the amount you paid to us in the six (6) months preceding the claim. Some states do not allow certain limitations; in such states, our liability will be limited to the maximum extent permitted by law.

19) Indemnification

You agree to indemnify and hold harmless Junk Car Medics and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

20) Communications

We may contact you by email, phone, SMS, push notifications, or through the Service regarding your account, transactions, and updates to the Service or these Terms. For SMS details, see Section 9 (SMS Terms and Consent).

21) Arbitration; Class Action Waiver

To the fullest extent permitted by law, any dispute or claim arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will occur in Monroe County, New York, unless the parties agree otherwise. Either party may bring an individual action in small-claims court instead of arbitration.

Class and Representative Actions Waiver. You and Junk Car Medics agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

30-Day Opt-Out. You may opt out of arbitration by sending a written notice to hello@junkcarmedics.com within thirty (30) days of your first use of the Service after these Terms’ Effective Date. Your opt-out will not affect any other terms.

22) Mobile App Terms (if applicable)

If you access any mobile application we make available, you must comply with the applicable app store terms (e.g., Apple App Store or Google Play). The app is licensed, not sold, and is provided “as-is.” Apple and Google are not responsible for the app or its content and are third-party beneficiaries solely to the extent required by their terms.

23) Availability Outside the U.S.

We do not warrant that the Service or any content is accessible or lawful outside the United States. Access from outside the U.S. is at your own risk. Any personal information you provide will be processed in the United States as described in our Privacy Policy.

24) No Third-Party Beneficiaries

There are no third-party beneficiaries to these Terms, except as expressly stated in Section 22 with respect to app store providers.

25) Amendments

We may amend these Terms by posting the updated version on the Service. Your continued use after the posting of changes constitutes acceptance of the updated Terms.

26) Entire Agreement; Severability; Waiver; Headings

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is held invalid, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. Headings are for convenience only.
